1. Agreement to Terms

By accessing or using BioRoot AI ("the Platform"), operated by EHB Aesthetics LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Not Medical Advice — Educational Tool Only

BioRoot AI is an educational wellness technology platform. It is NOT a medical provider, does NOT provide medical advice, and does NOT create a doctor-patient or provider-patient relationship.

All information, recommendations, care plans, supplement suggestions, peptide protocols, diet plans, exercise recommendations, lab interpretations, and other content generated by BioRoot AI are for educational and informational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

You must consult with a qualified, licensed healthcare provider before starting, stopping, or modifying any medication, supplement, peptide, hormone therapy, diet, exercise program, or other health protocol. Never disregard professional medical advice or delay seeking it because of information provided by BioRoot AI.

The AI-generated recommendations are based on the information you provide and general clinical knowledge. They do not account for all possible individual health factors, contraindications, or circumstances that a licensed healthcare provider would assess through a proper clinical evaluation.

3. User Responsibilities

By using BioRoot AI, you acknowledge and agree that:

You are at least 18 years of age.
You are solely responsible for any decisions you make regarding your health based on information from this Platform.
You will consult with a qualified healthcare provider before acting on any recommendations.
The information you provide (symptoms, lab results, medical history, etc.) is accurate to the best of your knowledge.
You understand that AI-generated recommendations may contain errors or may not be appropriate for your specific situation.
You will not use this Platform as a substitute for professional medical care, especially for emergency or acute conditions.
You assume all risk associated with using any information, recommendations, or content from this Platform.

4. Provider Mode Disclaimer

BioRoot AI's Provider Mode is designed as a clinical decision support tool for licensed healthcare professionals. It is intended to assist — not replace — clinical judgment. Licensed providers using the Platform remain solely responsible for all clinical decisions, prescriptions, and patient care. The Platform does not establish any standard of care.

5. No Patient-Identifying Information

BioRoot AI is designed as a de-identified clinical education tool. Users — including healthcare providers and their staff — must not enter patient names, dates of birth, Social Security numbers, medical record numbers, or any other personally identifiable information (PII) or protected health information (PHI) as defined under HIPAA.

The Platform accepts only de-identified clinical data (age, sex, symptoms, lab values, medications) for the purpose of generating educational guidance. BioRoot AI is not an electronic health record (EHR), not a patient portal, and not a covered entity under HIPAA. If you enter identifying information in violation of these terms, you do so at your own risk and responsibility.

SOAP notes, clinical summaries, and patient handouts generated by the Platform are templates only. Providers are responsible for adding patient-identifying details in their own medical record system after export.

6. AI-Generated Content

BioRoot AI uses artificial intelligence (powered by third-party AI services) to generate recommendations. AI-generated content:

May contain inaccuracies, errors, or outdated information.
Is generated based on patterns in training data and the information you provide — it does not "know" you as a patient.
Should always be verified by a qualified healthcare professional.
May include research citations that should be independently verified.
Is not a substitute for a proper clinical evaluation, physical examination, or diagnostic workup.

7. Data and Privacy

Your wellness data (symptoms, lab results, medical history, care plans, treatment tracking) is stored on our secure servers to provide cross-device access, treatment tracking, and reassessments. Your data is also sent to our AI provider (Anthropic) for analysis. For full details on how we handle your data, see our Privacy Policy.

By using the Platform, you consent to your wellness information being stored on our servers and transmitted to our AI service provider for the purpose of generating recommendations. Our AI provider does not use your data for training and deletes it in accordance with their data retention policies.

8. Third-Party Products and Services

BioRoot AI may recommend or link to third-party products, services, and providers including but not limited to:

Supplements via Fullscript and other dispensaries
Lab testing via partner laboratories
Genetic testing via partner testing services
Healthcare providers via our Provider Directory

Affiliate Disclosure: BioRoot AI and EHB Aesthetics LLC may earn a commission or referral fee when you purchase products or services through links on our Platform. All recommendations are based on clinical evidence and are not influenced by financial relationships. We only recommend products and services we believe provide genuine value.

We do not control, endorse, or guarantee the quality, safety, or efficacy of any third-party products or services. You assume all risk associated with purchasing or using third-party products.

9. Provider Directory

Healthcare providers listed in our directory are independent practitioners. BioRoot AI does not employ, supervise, or control listed providers. We do not verify their credentials, qualifications, or the quality of care they provide. Inclusion in our directory does not constitute an endorsement. You are responsible for verifying any provider's credentials and suitability for your needs.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EHB AESTHETICS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use of or inability to use the Platform;
Any recommendations, care plans, or content generated by the Platform;
Any health outcomes resulting from acting on information from the Platform;
Any third-party products or services purchased through the Platform;
Any unauthorized access to or alteration of your data;
Any errors, inaccuracies, or omissions in AI-generated content.

Our total aggregate liability for any claims arising from or relating to the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless EHB Aesthetics LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of any third party.

12. Subscription and Payment

Certain features of the Platform require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled. You may cancel at any time, and cancellation takes effect at the end of your current billing period. We reserve the right to change pricing with 30 days' notice.

13. Intellectual Property

All content, features, functionality, trademarks, and intellectual property on the Platform are owned by EHB Aesthetics LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our express written permission.

14. Termination

We reserve the right to suspend or terminate your account at any time, for any reason, without notice. Upon termination, your right to use the Platform ceases immediately. Server-stored data associated with your account will be deleted within 30 days. Data stored locally in your browser will remain on your device unless you clear it.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Dallas County, Texas.

16. Changes to Terms

We may update these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
